Get My QuoteRecords About People Who Cannot Protect Themselves
Every other business on this site holds data about adults who could, in principle, act on a warning. Yours does not.
Unused identities
A child’s details carry no credit history and no monitoring, which is exactly what makes them valuable and what makes the misuse invisible.
Custody and pickup lists
Authorized collection records and custody arrangements are safety information, not just administrative data.
Payment on file
Recurring tuition means stored cards or bank details sitting alongside everything else.
Remote access into the building
Parent apps and viewable camera feeds create a path from outside into a room full of children.
The People in Your Files Cannot Be Warned
Breach notification assumes a recipient who can act. In childcare, that assumption does not hold.
Notification runs to parents, by necessity
A two-year-old cannot freeze a credit file, cannot review a statement and will not be in a position to notice misuse until they apply for credit as an adult. The notice goes to a parent, who is being told about a harm that may surface fifteen years from now. That is a conversation no template handles well.
The safety records are not ordinary data
Authorized pickup lists and custody arrangements exist to keep a specific child away from a specific adult. Exposure of that information is a physical safety matter rather than a financial one, and it is the part of the incident a parent will react to first.
Licensing is the regulator that moves
FERPA generally does not reach a private childcare business, so the federal student privacy framework is not your reference point. State breach notification law sets the notice duty, and state licensing is the authority most likely to take an interest in how a center handles records about the children in its care.
Which federal rules reach which schools
- K-12 districts are reached by FERPA, because federal program funds reach the district, plus every state breach law your families live under.
- Private schools are reached by often NOT FERPA at all, if no federal program funds reach the school. State law is then the whole picture.
- Colleges and trade schools are reached by FERPA AND the Safeguards Rule, both triggered by the same decision to participate in Title IV.
- Childcare and early learning are reached by no FERPA, but state licensing and state breach law, for records about children too young to ever be notified.
Why it changes the policy conversation
Ask how long credit monitoring is offered, because the standard year is close to meaningless for a child, and confirm the policy funds counsel early given how fast a parent community reacts. Our data breach response guide walks through the sequence.
Built for a Conversation With Parents
Telling families properly
Breach response and notification fund reaching every family quickly and accurately, which is what determines how the community reacts.
Claims from parents
Third-party liability responds when families bring claims arising from exposure of their children’s information.
Payment data
Coverage responds where stored tuition payment details are involved alongside enrollment records.
The center stays open
Business interruption responds when enrollment, billing or check-in systems are unavailable and children still arrive at seven in the morning.
Before You Decide
The objections we actually hear from business owners, answered straight.
Does a daycare really hold data worth stealing?
It holds the cleanest identity data available anywhere. A child’s name, date of birth, home address and often a Social Security number, with no credit history attached and no adult monitoring it. For identity fraud that combination is more useful than an adult’s record, because it can be used for years before anyone has a reason to look.
Who do we notify if children’s records are exposed?
Parents and guardians, under your state’s breach notification law. The children themselves cannot act on the information, cannot freeze a credit file they do not have, and will not be in a position to check for well over a decade. That makes the notification conversation unusually difficult and the follow-up obligations unusually long.
What else is in our systems besides enrollment forms?
Typically far more than owners expect: stored payment cards or bank details for recurring tuition, immunization and allergy records, custody arrangements and authorized pickup lists, incident reports, staff background check results, and in many centers camera feeds parents can view remotely.
Are the parent-facing apps and cameras a risk?
They are the part most often overlooked. Check-in apps, messaging platforms and live camera access are convenience features that create a remote path into a building full of children, usually supplied by a vendor and administered by someone whose main job is not technology.
Does FERPA apply to a childcare business?
Generally no. FERPA reaches institutions that receive funds under programs administered by the Secretary of Education, which most private childcare operations do not. Your obligations come from state licensing requirements and state breach notification law instead, and licensing is the one a regulator is most likely to act on.
What does cyber liability insurance not cover for a childcare center?
It does not cover abuse or molestation allegations, child injury, or employment claims, each of which belongs to a separate and essential policy. It does not pay licensing penalties. It covers the incident response, notification to families, the liability that follows and the interruption to operations.
What Would Cyber Liability Insurance Cost Your Center?
Pricing follows licensed capacity, how many locations you run, whether you store payment details and camera feeds, and the controls you can evidence. See the breakdown in our cost guide, or get a number for your center.
