Where the Exposure Sits

The Only Breach That Opens a Door

Management is a data business whose most sensitive record is not a record at all. It is a code.

Means of entry, stored digitally

Lockbox codes, smart lock credentials, alarm codes and gate codes for occupied homes, usually held in the same platform as everything else.

Full financial pictures

Applications carry identity numbers, income documentation, bank detail and prior addresses, assembled for every applicant whether or not they moved in.

Money moving both ways

Rent arrives from tenants and distributions leave to owners, and you sit between two parties who rarely verify anything with each other.

Vendors inside your systems

Maintenance contractors hold logins and receive work orders that say who lives where and when the home will be empty.

The Obligation Nobody Counts

It Covers the People You Said No To

Most managers size their exposure by unit count. The federal rule sizes it by what is still sitting in the system.

What the rule reaches

The federal disposal rule applies to any person over which the Federal Trade Commission has jurisdiction that, for a business purpose, maintains or otherwise possesses consumer information. Consumer information is defined as any record about an individual that is a consumer report or is derived from a consumer report, in paper, electronic or any other form. Source: 16 CFR Part 682.

Why that includes rejected applicants

A tenant screening report is a consumer report, and your notes drawn from it are derived from one. The duty attaches to possessing the information for a business purpose. It does not ask whether you approved the person, and it does not end when they rent somewhere else. Every application you ever ran and never deleted is inside the obligation, and inside the breach count if your systems are reached.

Disposal includes giving the computer away

The rule defines disposal to include the discarding or abandonment of consumer information and also the sale, donation or transfer of any medium, including computer equipment, on which it is stored. Replacing office machines, passing a laptop to a new leasing agent or sending hardware to a recycler are all regulated acts rather than housekeeping.

And then there is the part that is not data

Notification law and disposal rules were written for information. They have nothing to say about the fact that a single export from your platform can contain working entry credentials for hundreds of occupied homes. That risk is not reduced by notifying anyone, which is why it belongs in how you segregate access credentials rather than in how you respond afterwards.

What each kind of business is really holding

  • Property managers hold keys, codes and access to homes people live in, alongside the application files that got them there.
  • Brokerages hold transaction data spread across devices owned by agents who are not your employees.
  • Community association managers hold reserve funds and owner financials for many associations at once, with boards that change every year.
  • Title and settlement companies hold the money, and a federal filing obligation that attaches to whoever sits highest in a defined cascade.

Why it changes the policy conversation

Your notifiable population is larger than your resident roster, often by years of applications, and your underwriter will want to know the real number. Our data breach response guide walks through how that population is established after an incident.

What the Policy Does for You

Built for Tenants, Owners and Everyone In Between

Working out who must be told

Breach coach and notification coverage establish the real population, which usually extends well past current residents.

Redirected rent and distributions

Funds transfer fraud and social engineering coverage respond to payments made on substituted instructions.

Claims from owners and residents

Third-party liability funds the defense when an owner or a tenant alleges your systems exposed them.

The portfolio keeps operating

Business interruption and extortion coverage respond when the management platform is locked and rent, maintenance and renewals do not pause.

Real Questions

Before You Decide

The objections we actually hear from business owners, answered straight.

What is the worst case in a property management breach?

It is not a notification letter. You hold the means of entry to homes people live in: lockbox codes, smart lock credentials, alarm codes, gate codes and master key inventories. Almost every other business can describe its worst breach as a financial or privacy harm. Yours includes someone being able to open a door, which is why access credentials deserve to be segregated from the rest of your systems.

Do we have obligations for applicants we turned down?

Yes, and this is the exposure most managers have never counted. The federal disposal rule applies to any person who, for a business purpose, maintains or otherwise possesses consumer information, and consumer information includes any record derived from a consumer report. A tenant screening report is a consumer report. The duty attaches to possessing the file, not to approving the applicant, so the rejected applications sitting in your system are covered by it just as the approved ones are.

Does replacing our office computers trigger anything?

Under the disposal rule it can. Disposal is defined to include not only discarding or abandoning consumer information but also the sale, donation or transfer of any medium, including computer equipment, on which it is stored. Handing old machines to a staff member or a recycler without verified destruction of the data is the exact scenario the rule was written to address.

Why is rent collection a cyber exposure rather than a banking one?

Because the instruction is what gets attacked, not the rail. An email telling tenants that payment details have changed, or a message to an owner redirecting a monthly distribution, does not require anyone to break into a payment system. You also sit between two parties who rarely speak to each other directly, which is the condition under which a substituted instruction looks ordinary to both of them.

Are our maintenance vendors part of our exposure?

They are, in two directions. Vendors receive work orders carrying tenant names, addresses, access instructions and often scheduling detail about when a home will be empty. They also frequently have a login to your management platform. A compromised vendor account is a working set of credentials inside your system, and it will not look unusual when it is used.

Does our general liability or property policy respond to this?

Not to the cyber part. General liability answers bodily injury and property damage, and a property policy answers physical loss. Neither funds forensics, tenant notification, credit monitoring or the defense of a claim brought by a tenant or an owner. If an access credential leak contributes to a physical incident, you may end up with both policies engaged and a coverage argument running between them.

What does cyber liability insurance not cover for a property manager?

It does not answer a habitability or negligence claim about the physical condition of a property, and it does not replace a fidelity bond for employee theft of funds. It also will not undo a disclosure: once tenant financial detail is out, no policy makes it private again. It covers the response, the liability and the interruption.

What Would Cyber Liability Insurance Cost Your Management Company?

Pricing follows units under management, how long you retain applications, whether you hold access credentials digitally and the controls you can evidence. See the breakdown in our cost guide, or get a number for your company.
