Get My QuoteTwo Federal Regimes, One Enrollment Decision
Participating in federal student aid brings obligations that no education regulation announces, and the consequence of failing them is unusually severe.
Eligibility, not a fine
A security finding is resolved against your administrative capability to participate, which for most institutions reaches the majority of revenue.
Financial aid files
Aid administration means tax returns, income data and Social Security numbers for students and often their parents, held for years.
Open by design
Campuses run networks intended to be reachable by thousands of transient users on unmanaged personal devices.
Decentralized everything
Departments buy their own systems, which means the institution rarely has one accurate list of where student data actually lives.
It Is in the Contract, Not the Regulation
This surprises administrators who have looked for it in the education rules and not found it, because it is not there.
What the Department actually said
Institutions were reminded that under their Program Participation Agreement and the Gramm-Leach-Bliley Act (15 U.S. Code 6801), they must protect student financial aid information, with particular attention to information provided by the Department or otherwise obtained in administering the Title IV programs. Source: Dear Colleague Letter GEN-16-12.
And what a finding costs
The amended Safeguards Rule took effect June 9, 2023, the Department enforces these requirements through annual compliance audits, and GLBA related findings have the same effect on an institution’s participation in the Title IV programs as other findings, resolved as part of the Department’s determination of administrative capability. Source: Department of Education.
The same decision also triggers FERPA
FERPA applies to an institution to which funds have been made available under a program administered by the Secretary, and the regulation expressly counts funds provided to students that may be paid to the institution by them, naming the Pell Grant and federal student loan programs. Source: 34 CFR 99.1. Participating in Title IV therefore pulls a school under both regimes at once.
Which federal rules reach which schools
- K-12 districts are reached by FERPA, because federal program funds reach the district, plus every state breach law your families live under.
- Private schools are reached by often NOT FERPA at all, if no federal program funds reach the school. State law is then the whole picture.
- Colleges and trade schools are reached by FERPA AND the Safeguards Rule, both triggered by the same decision to participate in Title IV.
- Childcare and early learning are reached by no FERPA, but state licensing and state breach law, for records about children too young to ever be notified.
Why it changes the policy conversation
Treat the insurance and the compliance work as separate budgets that answer similar questions. No policy restores eligibility, which means the controls carry weight the cover cannot. Our data breach response guide walks through what happens once an incident starts.
Built for an Institution That Cannot Simply Close
Student and family notification
Breach response funds notifying a population that includes students, parents and alumni across every state.
Counsel early
Breach coach access matters here because two federal regimes and a state statute can all be implicated by one event.
Teaching continues
Business interruption responds when learning platforms, registration or aid processing are unavailable mid-term.
Extortion
Cyber extortion coverage responds where research or student records are held rather than simply encrypted.
Before You Decide
The objections we actually hear from business owners, answered straight.
Why does the Safeguards Rule apply to a college at all?
Not because any education regulation says so. It applies because of what the institution signed. The Department of Education has told institutions that under their Program Participation Agreement and the Gramm-Leach-Bliley Act they must protect student financial aid information. The obligation arrives through the contract you entered to receive federal student aid, not through a rule aimed at schools.
What happens if we fail a GLBA audit?
It becomes a participation question rather than a privacy fine. The Department has said that GLBA related findings will have the same effect on an institution’s participation in the Title IV programs as other findings, resolved as part of its determination of administrative capability. For most institutions federal student aid is not a revenue line, it is the revenue, which makes this closer to the CMMC problem a defense supplier faces than to a typical data penalty.
Does taking Title IV also trigger FERPA?
Yes, and the two travel together for the same reason. FERPA applies to an institution to which funds have been made available under a program administered by the Secretary, and the regulation expressly counts funds provided to students that may be paid to the institution by those students, naming the Pell Grant and the federal student loan programs. One decision therefore pulls a school under two separate federal regimes at once.
Do trade schools and small institutions face the same requirements?
If they participate in Title IV, yes. The obligations follow the funding rather than the size or the sector, so a small proprietary school with a handful of programs is in the same position as a university with a security team. The difference is only in who is available to do the work.
Who actually audits this?
It surfaces through the annual compliance audit, which is how the Department said it would enforce these requirements. That means the finding typically arrives from your own auditor rather than from an investigation, and it arrives on a predictable schedule, which is unusual and worth using to your advantage.
What does cyber liability insurance not cover for a college?
It does not restore Title IV eligibility, fund a corrective action plan, or pay for the security program the audit expected to find. It does not answer an employment, athletics or Title IX matter. It covers the incident response, notification to students and staff, the liability claims and the interruption to operations.
What Would Cyber Liability Insurance Cost Your Institution?
Pricing follows enrollment, how aid data is segregated, how many systems hold student records, and the controls you can evidence. See the breakdown in our cost guide, or get a number for your school.
