Get My QuoteOne File, An Entire Person
An injury practice assembles more about a single human being than almost any business outside a hospital, and then holds their money too.
Medical history in full
Diagnosis, treatment, imaging, often mental health or substance use records. Obtained lawfully, and then sitting on your systems for the life of the matter and beyond.
Money that is not yours
Settlement proceeds pass through your trust account, which makes your disbursement emails worth intercepting.
Volume without infrastructure
High-volume practices run hundreds of active matters on a case management platform and a handful of staff, rarely with anyone whose job is security.
Vendors hold it too
Record retrieval services, medical funding companies, experts and co-counsel all receive copies, and each is another place the file can leak from.
Protected in the Hospital, Unprotected in Your File
The federal protection attached to a medical record does not travel with the record. It attaches to who is holding it.
When a law firm IS covered by HIPAA
A firm becomes a business associate when it provides legal services to or for a covered entity and that service involves disclosure of protected health information to the firm. A practice defending a hospital or a medical group is squarely in that position. Source: 45 CFR 160.103.
When it is not
A plaintiff’s firm is not acting for the covered entity. It obtains the client’s records with a signed authorization, which is the mechanism HIPAA provides for a disclosure the rules do not otherwise permit. 45 CFR 164.508. Once those records are in your file, the federal breach notification machinery that would govern the hospital does not reach you.
Why that is worse, not better
Losing the federal standard does not lower the obligation, it fragments it. Your duties come from your state’s breach notification statute, from every other state your clients live in, and from your bar’s confidentiality rule. A firm that does both plaintiff and defense work is in both regimes simultaneously, with one set of servers.
And the trust account sits alongside it
Under ABA Model Rule 1.15 a lawyer must hold property of clients or third persons separate from the lawyer’s own property. Source: ABA Model Rule 1.15. A settlement disbursement redirected by a spoofed email is simultaneously a client loss, an insurance claim and a bar problem.
What each kind of firm is really holding
- Personal injury firms hold medical records obtained under a HIPAA authorization, plus settlement funds. No federal breach standard reaches those records once you hold them.
- Real estate and closing practices hold other people’s entire home purchase, sitting in escrow. ABA Model Rule 1.15 requires it be held separate from firm property.
- Intellectual property firms hold unpublished inventions that are still trade secrets. 35 U.S.C. 122 binds the USPTO to confidence; nothing binds your file server.
Why it changes the policy conversation
With no federal template to follow, the valuable part of the policy is the breach coach who decides which states you must notify and what you must say. Our data breach response guide walks through the sequence.
Built for a File That Cannot Be Recalled
Counsel works out which law applies
Breach coach coverage funds the multi-state notification determination, which is the hardest part when no federal standard governs.
Clients are notified properly
Notification, credit monitoring and third-party liability respond when treatment and financial detail are exposed together.
Redirected disbursements
Funds transfer fraud and social engineering coverage answer a settlement payment sent on fraudulent instruction.
The practice keeps running
Business interruption and extortion coverage respond when the case management system is locked and deadlines do not move.
Before You Decide
The objections we actually hear from business owners, answered straight.
Is a personal injury firm a HIPAA business associate?
Usually not, and that surprises people. HIPAA makes a law firm a business associate when it provides legal services to or for a covered entity, which is the position of a firm defending a hospital. A plaintiff’s firm is on the other side: it obtains the client’s records under a signed authorization, so it is not performing a function for the covered entity and HIPAA does not follow the records into its file. A firm that does both plaintiff and defense work can be in both positions at once.
If HIPAA does not apply to our case files, what does?
State law and your bar’s ethics rules. Every state has a breach notification statute covering personal information, and your duty of confidentiality requires reasonable efforts to prevent unauthorized access to client information. What you lose is the single federal standard: no 60-day clock, no defined notification content, no one federal regulator. For a multi-state practice that is harder to navigate, not easier.
What makes injury case files more sensitive than other legal files?
The combination. One file can hold diagnosis and treatment history, mental health and substance use treatment, employment and wage records, and the financial detail of a settlement. Very few organizations outside healthcare assemble that much about one person in one place, and the people in those files are already going through the worst year of their lives.
Are settlement funds in our trust account an exposure?
Yes, and it is the one that moves fastest. Under ABA Model Rule 1.15 a lawyer must hold client and third-party property separate from the firm’s own, which means real money sits in your trust account on behalf of someone else. Disbursement instructions sent by email are exactly what business email compromise targets, and a redirected settlement payment is both a client loss and an ethics problem.
Does our malpractice policy cover a case file breach?
Do not assume so. Lawyers professional liability answers claims that your legal work fell below standard. It is generally not built to fund forensics, client notification, credit monitoring or a regulator’s questions, and any cyber endorsement attached to it is usually sublimited well below what a notification event costs. Map the two policies against each other rather than hoping they meet.
What does cyber liability insurance not cover for an injury firm?
It does not replace misappropriated client funds the way a fidelity bond or trust-account protection might, so the two should be read together. It does not answer a malpractice claim about how the case was handled, and it does not undo a disclosure: once a client’s treatment history is out, no policy makes it private again.
What Would Cyber Liability Insurance Cost Your Injury Practice?
Pricing follows caseload, how many records you hold, whether you run a trust account, and the controls you can evidence. See the breakdown in our cost guide, or get a number for your firm.
