You’re Not Alone If…

Technology Moved Faster Than Your Coverage Did

Most law firms we talk to haven’t thought about cyber risk until something already went wrong, or almost did.

You store customer data (names, payment info, maybe health records) and you’re not sure what your real exposure is if it’s breached.

You accept online payments or run point-of-sale systems, but have never confirmed whether a payment compromise is actually covered.

You’ve never been walked through what a ransomware attack would actually cost you in downtime, recovery, and lost business.

Your current policy, if you have one, was written before remote logins, cloud tools, and phishing emails became part of daily business.

Why Cyber Liability Coverage Matters for Law Firms

Law firms hold highly sensitive client data, trust account funds, and privileged case information, putting them squarely in the crosshairs of business email compromise schemes that redirect wire transfers during closings and settlements. Under ABA Model Rule of Professional Conduct 1.6(c), interpreted in ABA Formal Opinion 477R, attorneys must make reasonable efforts to prevent unauthorized access to client information, a duty most state bars have adopted in their own ethics rules.

BakerHostetler’s 2025 Data Security Incident Response Report found fraudulent fund transfers across its law firm and corporate client incidents totaled $109 million, a 211% year-over-year increase, with the average fraudulent wire climbing to $1.26 million. That is one reason more firms treat cyber liability coverage as a standard part of risk management rather than an afterthought.

Real Cyberattacks on Legal Businesses

If you run a law firm, a breach isn’t just a data-security problem, it’s a professional-ethics problem, since client confidentiality is a duty you carry under the rules that govern your license to practice.

  • 2016Moses Afonso Ryan Ltd.10-Lawyer Commercial Litigation Firm, Rhode Island

A ransomware attack knocked the firm offline for roughly three months; the firm paid a $25,000 ransom but claimed $700,000 in lost billable income and sued its own insurer for refusing to cover the business-interruption loss.

What This Means for Your Business

ABA Model Rule 1.6(c) requires lawyers to make reasonable efforts to prevent unauthorized disclosure of client information, and ABA Formal Opinion 483 spells out an affirmative duty to monitor for breaches, act to stop an ongoing one, and notify affected clients. A cyber incident at a firm can trigger a professional-ethics violation on top of the data-breach liability itself, exactly the gap the Moses Afonso Ryan case exposed when business-interruption coverage didn’t apply the way the firm expected. Real Questions

Before You Decide

The objections we actually hear from business owners, answered straight.

Do law firms need cyber liability insurance?

A firm breach is an ethics problem as well as a data problem, which is unusual. The American Bar Association’s 2023 Cybersecurity TechReport found 29% of firms had experienced a security breach and a further 19% did not know whether they had. Not knowing is itself a difficulty when a duty to notify attaches.

What does cyber liability insurance cover for a law firm?

Forensics, client notification, regulatory and disciplinary defense, extortion response, and business interruption. For firms handling closings or holding client funds, funds transfer fraud cover is the provision that answers an intercepted wire instruction.

What does cyber liability insurance not cover for a law firm?

It is not legal malpractice cover. A claim that your representation fell short belongs to the malpractice policy, and most malpractice policies in turn exclude or heavily sublimit breach response costs, which is why firms generally need both.

Do the ABA rules require a law firm to report a breach?

The duty is real even though it is not an insurance mandate. ABA Model Rule 1.6(c) requires reasonable efforts to prevent unauthorized disclosure of client information, and ABA Formal Opinion 483 sets out an affirmative duty to monitor for breaches, act to stop one in progress, and notify affected clients. That is an ethics exposure sitting on top of the data-breach liability.

How much does cyber liability insurance cost for a law firm?

Most small businesses pay between $400 and $8,000 a year, with the average landing around $1,500. For firms the drivers are practice area, whether you hold client funds or handle closings, and headcount. Firms handling real estate or escrow usually price higher because of wire fraud exposure. See the cost guide, or get a number for your firm.

Doesn’t my malpractice insurance cover a data breach?

Usually not. Legal malpractice policies are built around claims of professional negligence, not cyber incidents, and most either exclude breach response costs or sublimit them well below what an actual incident costs.

What Does Your Practice Actually Hold?
