Cyber Liability Insurance for Private and Independent Schools

FERPA may not reach your school at all, and you hold donor records a public district never has. Cyber Insurance Group has agents dedicated to cyber liability, comparing independent school coverage across 12+ A-rated carriers.

Compare your school across 12+ A-rated carriers in about 4 minutes. Free, no obligation, and no need to know your limits in advance. We are an independent agency, so the recommendation is based on what covers your risk, not on one carrier’s product sheet.

Where the Exposure Sits

A School, a Charity and a Small Business at Once

An independent school holds three kinds of sensitive record that rarely sit together anywhere else.

Student and family files

Admissions assessments, learning support plans and family circumstances, held for children, often across many years.

Development records

Giving history, capacity ratings and candid staff notes about the families you depend on for capital campaigns.

Tuition and financial aid

Payment plans and need-based aid applications bring household financial data into a school office.

No federal reference point

Without FERPA, there is no single standard to work from, only a patchwork of state statutes and your own promises.

The Rule That May Not Be Yours

FERPA Follows the Funding, Not the Ownership

Most people assume FERPA is the student privacy law for all schools. The regulation says something narrower.

What the regulation says

The rules apply to an educational agency or institution to which funds have been made available under any program administered by the Secretary. They expressly do not apply to an institution merely because its students receive non-monetary benefits under such a program, where no program funds reach the institution. Source: 34 CFR 99.1.

Which splits the word “private” in two

An independent K-12 school taking no federal program funds is frequently outside FERPA altogether. A private college whose students pay using Pell Grants or federal student loans is inside it, because the regulation counts funds paid to the institution by students under those programs. Same adjective, opposite answer, decided by money rather than ownership.

Being outside is not an advantage

It removes a reference point rather than an obligation. Your duties come from your state’s breach notification statute, from every other state your families live in, from your enrollment contracts, and from the privacy policy on your own website. That is more work to establish, not less, and it has to be done while an incident is running.

Which federal rules reach which schools

  • K-12 districts are reached by FERPA, because federal program funds reach the district, plus every state breach law your families live under.
  • Private schools are reached by often NOT FERPA at all, if no federal program funds reach the school. State law is then the whole picture.
  • Colleges and trade schools are reached by FERPA AND the Safeguards Rule, both triggered by the same decision to participate in Title IV.
  • Childcare and early learning are reached by no FERPA, but state licensing and state breach law, for records about children too young to ever be notified.

Why it changes the policy conversation

The valuable part of the policy here is counsel who can work out, quickly, which states you must notify and what your own published promises committed you to. Our data breach response guide walks through the sequence.

What the Policy Does for You

Built for a Community That Chose You Privately

Working out who to tell

Breach coach coverage funds the multi-state determination that no single federal standard answers for you.

Families and donors

Notification and third-party liability respond when student, family or development records are exposed.

Reputation and enrollment

Crisis management coverage matters more here than at a district, because the consequence shows up at re-enrollment.

The school stays open

Business interruption responds when the systems running admissions, billing or instruction are unavailable.

Real Questions

Before You Decide

The objections we actually hear from business owners, answered straight.

Does FERPA apply to an independent school?

Often not, and that is worth establishing rather than assuming. The regulation applies to an institution to which funds have been made available under a program administered by the Secretary of Education, and it expressly does not apply merely because students receive non-monetary benefits where no program funds reach the school. An independent K-12 school that takes no such funds is frequently outside FERPA altogether.

Then what governs our student records?

State law, your enrollment contracts and your own published policies. Every state has a breach notification statute covering personal information, and for a school drawing families from several states that can mean several statutes from one incident. What you lose is a single federal reference point, which makes the determination harder rather than easier.

Is a private college in the same position as a private school?

No, and the difference is the money. Where students pay the institution using Pell Grants or federal student loans, the regulation counts that as funds made available, so a private college is generally inside FERPA. Participating in Title IV also brings the Safeguards Rule through the Program Participation Agreement, which our colleges and trade schools page covers.

What makes donor data a different kind of risk?

It is the one dataset where exposure costs you future revenue directly. Development records hold giving history, capacity ratings, family circumstances and candid notes written by staff who never expected them to be read aloud. A breach there damages the relationships the school depends on for capital campaigns, and no notification letter repairs that.

Do our families expect more than the law requires?

Almost always, and that gap is the real exposure. Families paying substantial tuition for discretion do not distinguish between a legal obligation and an expectation of privacy. The reputational consequence of a breach at an independent school is driven by enrollment and word of mouth rather than by a regulator.

What does cyber liability insurance not cover for a private school?

It does not cover employment matters, abuse allegations or student injury, which belong to other policies. It does not recover gifts that do not arrive after a development data exposure. It covers the incident response, notification to families, the liability claims and the interruption to operations.

What Would Cyber Liability Insurance Cost Your School?

Pricing follows enrollment, whether you hold development and financial aid records, how many states your families live in, and the controls you can evidence. See the breakdown in our cost guide, or get a number for your school.
